Please read these terms carefully before engaging our services. By submitting our contact form, entering into a service agreement with us, or using our website, you confirm that you have read and agree to these terms.
1. Definitions
In these terms:
- "Services" means the family law services offered by khwanjaa Legal, including reconciliation mediation sessions, cohabitation agreement drafting, and family estate pre-planning.
- "We / Us / Our" refers to khwanjaa Legal, registered and practising in Bangkok, Thailand.
- "You / Client" refers to any individual who engages our services or uses our website.
- "Agreement" means the engagement letter or service agreement entered into between you and khwanjaa Legal for a specific service.
- "Website" means the website located at khwanjaa.pro.
2. Acceptance of Terms
By using our website or engaging our services, you confirm that:
- You are at least 18 years of age, or the legal age of majority in your jurisdiction if higher
- You have the legal capacity to enter into binding agreements
- You agree to be bound by these terms and any specific engagement agreement for the service you request
If you are acting on behalf of another person or a family group, you confirm that you have authority to bind those persons to these terms.
3. Service Description
khwanjaa Legal provides family law support services in Thailand, specifically:
- Reconciliation Mediation Session (5,500 THB per session): A structured mediation session for couples, preceded by a written agenda and followed by a written summary note.
- Cohabitation Agreement Drafting (9,800 THB): Drafting of a plain-language written agreement for unmarried couples covering financial arrangements and shared property.
- Family Estate Pre-planning (14,600 THB): A comprehensive service including an asset inventory, individual family conversations, a coordinated written plan, and an annual review schedule.
Services are provided in English and Thai. They are available to clients based in Thailand or with legal matters arising under Thai jurisdiction. We will advise you clearly if a matter falls outside our scope of practice.
4. User Responsibilities
By engaging our services, you agree to:
- Provide accurate and complete information relevant to your matter
- Notify us promptly if circumstances material to your matter change
- Treat our practitioners and staff with courtesy and respect
- Not use our services for any unlawful purpose
- Not misrepresent your identity or legal capacity
- Maintain confidentiality about the contents of any mediation session or document drafting process in which other parties are involved, except as required by law
5. Payment Terms
All fees are stated in Thai Baht (THB) and are inclusive of applicable taxes unless otherwise stated. Payment is due as follows:
- Mediation sessions: full payment due prior to the session date
- Cohabitation agreement drafting: 50% on engagement, 50% on delivery of the final agreed document
- Family estate pre-planning: 40% on engagement, 40% on delivery of the coordinated plan, 20% on confirmation of the annual review schedule
We accept bank transfer and other payment methods confirmed at engagement. Fees are non-refundable except as set out in section 6.
If a matter is significantly more complex than anticipated at engagement, we will discuss any adjustment to fees before continuing. No additional fee will be charged without your written agreement.
6. Service-Specific Terms
Mediation sessions
A session may be rescheduled with at least 48 hours' notice at no charge. Cancellation within 48 hours of the session time will result in a cancellation fee of 2,000 THB. If both parties withdraw before the session takes place, any amount paid above the cancellation fee will be refunded.
Cohabitation agreement drafting
The fee covers the initial conversation, drafting, and up to three rounds of revision. Additional revision rounds requested beyond the third will be charged at 1,500 THB per round, agreed in writing before the work proceeds.
Family estate pre-planning
The annual review schedule included in this service covers one review contact per year for the first two years from plan delivery. Subsequent review contacts or revisions to the plan are available at agreed rates.
7. Confidentiality
All information shared with us in the course of an engagement is treated as strictly confidential. We will not disclose any information about your matter to third parties without your explicit written consent, except as required by Thai law or a binding court order. All practitioners and staff at khwanjaa Legal are bound by confidentiality obligations.
In mediation sessions involving two parties, each party should be aware that what is discussed is shared with the other party present in the session, and summarised in the post-session note shared with both.
8. Intellectual Property
All content on our website — including text, design, and layout — is the intellectual property of khwanjaa Legal and may not be reproduced without our written permission. Documents drafted by us in the course of a service engagement become your property on payment of the relevant fee and may be used freely for the purpose for which they were prepared.
9. Disclaimers
Our services are provided by qualified legal practitioners and are intended to assist you in making your own informed decisions. We do not provide court representation or advocacy services. Mediation sessions are facilitated conversations and do not constitute legal advice binding on either party. We do not promise specific outcomes from any service.
Website content is provided for general information only and does not constitute legal advice. You should not act on information from our website without first seeking specific advice relevant to your circumstances.
10. Limitation of Liability
To the fullest extent permitted by Thai law, our total liability to you in connection with any service shall not exceed the fee paid by you for that specific service. We are not liable for any indirect, consequential, or special loss arising from our services or their outcome. Nothing in these terms excludes liability for fraud or gross negligence on our part.
11. Indemnification
You agree to indemnify khwanjaa Legal against any claim, loss, or expense arising from your breach of these terms, your provision of inaccurate information, or your unlawful use of our services or website.
12. Termination
Either party may terminate a service engagement by written notice. If we terminate, we will refund any portion of a fixed fee that corresponds to work not yet completed. If you terminate, refunds will be calculated based on work completed to that point. Sections on confidentiality, intellectual property, liability, and dispute resolution survive termination.
13. Dispute Resolution
These terms are governed by the laws of Thailand. Any dispute arising from our services will first be subject to good-faith negotiation. If negotiation does not resolve the matter within 30 days, either party may refer the dispute to the Thai Arbitration Institute or the competent courts of Bangkok, at the referring party's election. We support the use of mediation as a first step in any dispute — consistent with our practice.
14. General Provisions
- Entire agreement: These terms, together with any specific engagement agreement, constitute the entire agreement between us on the matters they cover.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
- Assignment: You may not assign your rights under these terms without our written consent.
- Notices: Formal notices should be sent by email to [email protected] or by post to our Sukhumvit office.
15. Changes to These Terms
We may update these terms periodically. Material changes will be noted on our website. The effective date at the top of this page indicates when the current version took effect. Continued engagement with our services after a change constitutes acceptance of the updated terms.
